Visit us at www.nestle.com.<br><br><strong>POSITION SNAPSHOT<br><br></strong>Company: Nestlé MENA<br><br>Location: Casablanca, Morocco<br><br><strong>Position Summary<br><br></strong>Nestlé Morocco is looking for someone to be a business partner who proactively shapes and challenges within the business and externally by delivering legal, compliance, regulatory and risk and reputational management strategies and solutions to NiM businesses and functions in the country or region.<br><br><strong>A DAY IN THE LIFE OF A LEGAL COUNSEL<br><br></strong><strong>Legal Strategy<br></strong><ul><li>Support Northwest Africa Cluster (Morocco, Algeria, Tunisia, and Libya) in developing, communicating, and executing legal, compliance, regulatory and risk management strategies for NiM.<br><br></li></ul><strong>Team managements<br></strong><ul><li>Take a leadership role within the function in Northwest Africa Cluster. With minimal supervision lead from Head of Legal, develop and coach members of the Legal team.<br><br></li></ul><strong>Disputes resolution, investigations & litigation<br></strong><ul><li>Responsible for managing the various disputes and coordinating litigation of Nestlé affiliates in MENA.</li><li>Attend court cases as a representative of Nestlé company and/or as a witness.</li><li>Follow-up and monitor of court cases with the local lawyers and update the internal stakeholders accordingly.</li><li>Review pleadings/memorandums.</li><li>Collaborate with the General Counsel, Country Manager, Finance Manager and Legal team members of MENA Legal to follow-up litigation cases and to efficiently resolve lawsuits.</li><li>Define strategy for specific disputes and investigations.</li><li>Managing disputes and investigation.<br><br></li></ul><strong>Contract Law<br></strong><ul><li>Partner function responsible for significant commercial or project-based arrangements.</li><li>Draft (from templates and/or from scratch), review, amend, revise, negotiate and terminate all commercial contracts, agreements, and legal documents of any nature.</li><li>Provide business-oriented legal advice on agreements/contracts directly to the relevant category/division/business unit.</li><li>Collaborate with and facilitate cross-team decision-making with the relevant category/business team/division and/or any other relevant internal stakeholder.</li><li>Drive contract lifecycle from drafting to signature through completion of the full negotiation process till signature.</li><li>Maintain a deep understanding of local laws and regulations, contracts, SOP, Z-EMENA legal requirements, legal risk and liability and Nestlé Group risks position on various matters.</li><li>Interpret contracts and advise categories/business units on contractual responsibilities and risks mitigation.</li><li>Drive contract and other Legal processes standartisation and automation.<br><br></li></ul><strong>Corporate Law and Commercial Law<br></strong><ul><li>Support Nestle affiliates on all corporate and commercial matters by providing business legal advice in Northwest Africa Cluster.<br><br></li></ul><strong>Legal Risk Management<br></strong><ul><li>Protect Nestlé by reducing/minimizing the risks and closing the gaps and help Nestlé affiliates’ management to execute flawlessly its business objectives.</li><li>Develop, implement, and manage a strategic plan for the provision of legal services in accordance with and in support of business objectives.</li><li>Provide business legal advice, assistance, and support.</li><li>Liaise with relevant departments to ensure that where legal risks have been identified, appropriate courses of actions to close the gaps have been taken.</li><li>Provide risk management advice to internal stakeholders.<br><br></li></ul><strong>Intellectual Property<br></strong><ul><li>Coordinate with the IP Champion the protection, enforcement, and defense of the intellectual property rights (IPR) of Société des Products Nestlé S.A. in the MENA.<br><br></li></ul><strong>Data Privacy<br></strong><ul><li>Coordinate with the Data Privacy Champion the privacy and the protection of personal data captured, used, and shared by our Nestlé affiliates in MENA countries.<br><br></li></ul><strong>Digital & social media<br></strong><ul><li>Coordinate with the Digital Champion and advise on any digital matter and with any relevant authority.<br><br></li></ul><strong>Antitrust Law<br></strong><ul><li>Provide legal advice on antitrust and competition matters.</li><li>Manage risk assessment.</li><li>Lead internal due diligence, audit and investigations.</li><li>Roll out Compliance Program & Training.<br><br></li></ul><strong>Corporate Secretary and governance<br></strong><ul><li>Act as Corporate Secretary for Nestle affiliates in his/her area of responsibility.</li><li>Insure high standard of corporate governance.<br><br></li></ul><strong>Labour Law<br></strong><ul><li>Legal Business Partner for HR (employment contracts, terminations, dismissals, labour litigation etc.)</li><li>Provide legal advice aimed at shaping people strategy.<br><br></li></ul><strong>What Will Make You Successful…<br></strong><ul><li>Master’s degree in law (business law/corporate Law/commercial law).</li><li>Minimum 2-4 years of experience.</li><li>Admitted to the Bar Association.</li><li>Fluent in Arabic, French, and English.</li><li>Experience in contract and commercial laws is mandatory.</li><li>Law practice in a law firm or as in-house legal counsel in a multinational company (ideally within FMCG) or a combination of both.</li><li>Good knowledge of company law, contract law, competition law, unfair competition law, data protection law, M & A law, and IP law.</li><li>Good knowledge of employment law.<br></li></ul>We offer a dynamic, inclusive, and international working environment with many opportunities across different companies, functions, and regions.
