<p><strong>Job Summary</strong></p><p>The Manager – Contracts in Qatar is responsible for the preparation, review and administration of construction supervision/PMCM contracts (pre &amp; post award). He is accountable to safeguard K&amp;A’s interests in all contracts signed by the company in Qatar from the proposal development stage to contract administration during delivery and handing over stages. This includes but is not limited to preparing / reviewing supervision contracts, addressing contractual matters, resolving disputes and providing expert advice. The jobholder is responsible to monitor overall contractual/commercial risk exposure for all supervision/PMCM projects in Qatar and to devise mitigation measures to address these risks. He shall stay abreast of the latest contractual trends in the Architecture, Engineering and Planning Industry and adopt best practices, where applicable. Moreover, the candidate will be responsible to oversee &amp; manage all the local PMCM/supervision projects resource allocation &amp; planning from the corporate/head office level to ensure no contractual/commercial clashes occur with the clients or internally during the project life cycle</p><p><br></p><p><strong>Key Responsibilities (Financial)</strong></p><ul><li>Develop the Contracts Section/division annual budget and raise to the Geography Manager for review.</li><li>Manage capacity and utilization levels of the Contracts Division &amp; Supervision/PMCM department staff as per targets, and manage resources in coordination with HR and Geo Head accordingly.</li><li>Provide expert advice to concerned stakeholders (internal &amp; external) related to PMCM/Supervision contracts including senior management and supervision project teams, as needed.</li><li>Provide contractual advice to Supervision Project Managers/Resident Engineers and supervision teams in settlement of claims, variation orders and disputes between contractors and clients during supervision/PMCM projects, as needed.</li><li>Support the Contracts Division/Team in Engineering Services in managing and settling large claims and variation orders arising from design changes or any other changes during the pre or post contract stage (supervision stage).</li></ul><p><br></p><p><strong>Key Responsibilities (Customer Focus)</strong></p><ul><li>Assess contractual/commercial risk in supervision contracts during the proposal development stage and devise mitigation measures accordingly.</li><li>Coordinate with the Contracts Division in Engineering Services and the Global Contracts Department for expert advice during the preparation and administration of K&amp;A PMCM/supervision contracts in Qatar.</li><li>Coordinate with the Contracts team and other cross functional team members to ensure the adherence of supervision/PMCM contracts to policies and procedures as set out by the Global Contracts Department</li><li>Prepare / review contract terms and conditions for K&amp;A supervision/PMCM contracts in Qatar and sign off final contract documents</li><li>Monitor and administer all ongoing PMCM/supervision projects from a contractual/commercial aspect</li></ul><p><br></p><p><strong>Key Responsibilities (Internal Business Process)</strong></p><ul><li>Assess the contractual/commercial implication of PMCM/supervision project scope changes, including suitability of claims, variation orders etc.</li><li>Maintain &amp; Report the commercial health/status of all supervision/PMCM projects in Qatar and support the design/projects managers (as needed) to properly apply for claims/EOT on ongoing design projects in Qatar (if required/instructed).</li><li>Assess and settle large claims, variation orders and disputes between K&amp;A and clients related to PMCM/supervision contracts.</li><li>Manage contractor claims, variation orders and contractual disputes on behalf of clients, as/when requested.</li><li>Oversee K&amp;A’s risk exposure on all locally signed contracts and ensure risk management measures are in place and escalate major issues to the Geography Manager.</li><li>Liaise with the Global Legal Department for the provision of expert legal advice in PMCM/supervision contracts (as and when required).</li><li>Ensure that all new joiners in the contracts/QS division are inducted and trained on K&amp;A’s policies and procedures</li><li>Develop training plans and technology upgrade requests for the Contracts Division and raise to the Senior Manager or GEO Head of Qatar for review</li><li>Ensure implementation of knowledge management policies and procedures in the Contracts/QS Division</li><li>Implement risk management policies and procedures </li><li>Implement corporate policies and procedures</li><li>Ensure consistency, coordination and high quality service delivery of all resources in the Contracts/QS department</li><li>Research contractual trends in the Architecture, Engineering and Planning Industry and ensure that K&amp;A is at the forefront of contractual best practices</li><li>Develop manpower plan for the Contracts/QS department and raise to the Senior Manager or Geography Head for review.</li><li>Support the proposal development team in building the commercial cost estimate of supervision/PMCM projects and recommending internal or external resources best matched to help K&amp;A win the bid.</li><li>Build capabilities within the Contracts/QS division, develop skills of direct reports, and ensure that training plans are in place to develop the Division’s staff technically in their respective field(s). </li></ul><p><br></p><p><strong>Key Responsibilities (Learning &amp; Growth)</strong></p><ul><li>Create and maintain archive of supervision/PMCM contracts developed for past projects (by Geography, Client, etc.) for future reference </li><li>Act as a key resource and liaison to other functional areas of the business, building cross-functional relationships as needed</li><li>Act as a role model by maintaining a stellar company image during any networking &amp; corporate events</li></ul><p> </p><p><strong>Qualification, Technical Skills and Competencies</strong></p><ul><li>Bachelor’s Degree in Engineering, Architecture, or Construction Management</li><li>Master’s Degree in Construction Management or Construction Law is an advantage</li><li>Chartered Professional Engineering certification or equivalent is required (MRICS or MCIOB)</li><li>Knowledge of Architecture, Engineering and Planning Industry trends and competitive landscape in Qatar and the Middle East</li><li>Familiarity with local laws regulating the engineering / construction sectors in Qatar and the Middle East</li><li>Knowledge of risk management strategies </li><li>Ability to elicit cooperation from a wide variety of stakeholders, including senior management, clients and various departments</li><li>Excellent interpersonal and leadership skills</li><li>Proficiency in spoken and written English; Arabic is an advantage</li></ul><p><br></p><p><strong>Overall Experience Required to Execute this Role</strong></p><ul><li>15+ years of experience in the Architecture, Engineering and Planning Industry in a top tier regional / multinational engineering consultancy firm, specifically in a contracts / contracts administration role</li></ul><p><br></p><p><strong>Specific Experience Required to Execute this Role</strong></p><ul><li>15+ years of experience in the Architecture, Engineering and Planning Industry in a top tier regional / multinational engineering consultancy firm, specifically in a contracts / contracts administration role</li><li>Experience with standard &amp; bespoke conditions of contract, including such conditions as those developed by the FIDIC, AIA, EJCDC, ICE, etc.</li><li>Experience in negotiating, writing, and interpreting terms, conditions, and requirements of contractual agreements</li><li>Experience in evaluating and settling claims, and managing disputes</li><li>Exposure to global best practices and trends in the Architecture, Engineering and Planning Industry, in particular related to contracts</li><li>Significant industry experience within the Middle East</li></ul>
